Website Terms of Use

1. General provisions
- These Terms of Use define the rules for using the website available at ato.pl, including its language versions and subpages, hereinafter referred to as the “Website”.
- The owner and administrator of the Website is ATO SIGNAGE spółka z ograniczoną odpowiedzialnością with its registered office in Kalisz, address: Aleja Wojska Polskiego 29B, 62-800 Kalisz, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number: 0000700288, NIP: 6182136552, REGON: 301888834, hereinafter referred to as the “Service Provider” or “ATO SIGNAGE”.

- The Website is informational, promotional and contact-oriented in nature. Its purpose is to present the activities, services, projects, experience, contact details and recruitment information of ATO SIGNAGE.
- Use of the Website means acceptance of these Terms of Use. A User who does not accept the Terms of Use should stop using the Website.
- The Terms of Use are made available free of charge in a manner that allows them to be obtained, reproduced and stored.
2. Definitions
For the purposes of these Terms of Use, the following terms shall have the meanings indicated below:
- Terms of Use — this document setting out the rules for using the Website.
- Website — the website available at atosignage.com, together with its subpages and language versions.
- Service Provider — ATO SIGNAGE Sp. z o.o. with its registered office in Kalisz.
- User — any person using the Website.
- Electronic services — services provided electronically through the Website, consisting in particular of enabling Users to browse the content of the Website, use the information available on the Website and contact the Service Provider using the contact details indicated on the Website.
- Materials — all content available on the Website, in particular texts, photographs, graphics, designs, trademarks, logos, Website layout, project descriptions, video materials and other visual or informational elements.
3. Nature and scope of the Website
- The Website is used to present the activities of ATO SIGNAGE, in particular in the field of design, production, installation and maintenance of signage, visual identity elements, lighting solutions, façade elements and solutions intended for retail chains and commercial facilities.
- Information published on the Website is general and informational in nature.
- Content available on the Website does not constitute an offer within the meaning of the provisions of the Polish Civil Code, unless a given piece of content clearly states otherwise.
- Publishing information about the services, projects or implementations of ATO SIGNAGE does not constitute an obligation of the Service Provider to perform a specific service under the same conditions.
- Projects, photographs, project descriptions, graphic materials and information about cooperation with clients presented on the Website are intended to show the experience, capabilities and scope of activity of ATO SIGNAGE.
- The Service Provider may change, update or remove content available on the Website, including service descriptions, projects, contact details, organisational information and recruitment information.
4. Rules for using the Website
- The User is obliged to use the Website in accordance with the law, good practices, these Terms of Use and with respect for the rights of the Service Provider and third parties.
- In particular, it is prohibited to:
- provide or transmit unlawful content;
- take actions that may interfere with the operation of the Website;
- attempt to gain unauthorised access to the IT systems of the Service Provider;
- use the Website to distribute spam, malware or other harmful content;
- copy, distribute or use Materials from the Website without the consent of the Service Provider, except in cases permitted by law;
- automatically download content from the Website, including by means of robots, crawlers, scrapers or similar tools, if this infringes the rights of the Service Provider or disrupts the operation of the Website;
- take actions that infringe copyrights, industrial property rights, personal rights or other rights of the Service Provider or third parties.
- The User is obliged to provide true, up-to-date and non-misleading information when contacting the Service Provider.
- The User should not send special categories of data, in particular data concerning health, political opinions, religious beliefs, biometric data, genetic data or other sensitive data, unless this is necessary and clearly justified by the nature of the matter.
5. Technical requirements
- To use the Website, a device with Internet access, an up-to-date web browser and support for basic web technologies such as HTML, CSS and JavaScript are required.
- Some functions of the Website may require technical mechanisms necessary for its proper operation.
- The Service Provider does not guarantee that the Website will operate without interruptions or errors on every device, operating system or browser configuration.
- The Service Provider may temporarily restrict access to the Website for technical, security, maintenance or organisational reasons.
6. Contact with the Service Provider
- The Website enables contact with the Service Provider using the contact details indicated on the Website, in particular the e-mail address, telephone number and registered office address.
- Sending a message to the Service Provider does not constitute conclusion of a contract or acceptance of an offer by the Service Provider.
- A response to an enquiry depends on the nature of the message, team availability and the possibility of carrying out a given project or enquiry.
- The Service Provider reserves the right to leave unanswered messages that:
- are unlawful;
- constitute spam;
- contain offensive, vulgar content or content infringing the rights of third parties;
- do not concern the activity of the Service Provider;
- contain malware, suspicious attachments or links;
- are clearly automated, mass-sent or unrelated to the purpose of the Website.
7. Recruitment
- The Website may contain information about current job offers or contact opportunities related to recruitment.
- The Website may contain a button or link “Send application”, which enables the preparation of an e-mail message addressed to ATO SIGNAGE. Sending an application takes place through the e-mail software or e-mail service used by the User.
- ATO SIGNAGE does not operate candidate accounts, a recruitment panel or a recruitment form that stores data directly on the Website, unless a given functionality clearly indicates otherwise.
- Sending a recruitment application means the candidate voluntarily provides personal data contained in the e-mail message and attachments, in particular in a CV, cover letter or portfolio.
- The candidate should provide only data necessary to participate in the recruitment process, in particular contact details, information about professional experience, education, qualifications and skills.
- The candidate should not provide special categories of data, in particular data concerning health, political opinions, religious beliefs, trade union membership, biometric data, genetic data or data concerning sex life, unless this is necessary and clearly justified.
- Sending a recruitment application does not guarantee participation in the recruitment process or employment.
- Detailed information on the processing of personal data of job candidates is provided in the document Privacy and Cookies Policy or in a separate information notice on the processing of personal data of job candidates, if such notice has been published on the Website.
- If the candidate wishes their data to be processed also for future recruitment processes, they should give separate consent in the e-mail message or in the application documents.
8. Intellectual property rights
- Materials available on the Website, in particular texts, photographs, graphics, designs, logos, Website layout, visual elements, video materials, project descriptions and other content, may constitute works protected by copyright, trademarks, business identifiers or other legally protected goods.
- Rights to the Materials available on the Website belong to the Service Provider or to third parties that have granted the Service Provider appropriate rights, licences or consents.
- Use of the Website does not grant the User any licence to use the Materials available on the Website, unless expressly stated otherwise.
- It is prohibited to copy, modify, distribute, publish, commercially use or make available Materials from the Website without the prior consent of the Service Provider, except in cases provided for by applicable law.
- Trademarks, logos and names of clients or partners presented on the Website are used solely to present experience, projects or the scope of cooperation, unless the context indicates otherwise.
- Presentation of logos, names or projects completed for clients does not mean that the User may use these designations in their own materials or communication.
9. Links to external websites and social media
- The Website may contain links to external websites, in particular to ATO SIGNAGE profiles on social media such as Facebook and LinkedIn.
- Clicking a link leading to an external service redirects the User to a third-party website. From that moment, the terms of use, privacy policies and cookies policies of that external service apply.
- The Service Provider is not responsible for the content, operating rules, privacy policies or cookies practices used by external websites to which links placed on the Website lead.
- The mere placement of a link to a social media profile does not mean that the Service Provider tracks Users on the Website for marketing purposes.
10. Personal data protection and cookies
- The rules for processing personal data of Users, persons contacting the Service Provider and job candidates are set out in:
- Privacy and Cookies Policy,
- Information notice on the processing of personal data of job candidates, if applicable.
- According to the current configuration, the Website does not store analytical or marketing cookies in the User’s browser.
- According to the current configuration, the Website does not actively use tools such as Google Analytics, Meta Pixel, LinkedIn Insight Tag or other tools used to track Users for analytical, advertising or remarketing purposes.
- The Website may use only technical mechanisms necessary for its proper operation, security, loading of content or maintaining connection with the server.
- Detailed information regarding cookies and similar technologies is provided in the document Privacy and Cookies Policy.
11. Liability
- The Service Provider makes efforts to ensure that information available on the Website is up-to-date, reliable and correct, but does not guarantee its full completeness or uninterrupted accuracy.
- Information published on the Website does not constitute technical, legal, financial or investment advice.
- The Service Provider shall not be liable for:
- consequences of using the Website in a manner contrary to the law or these Terms of Use;
- interruptions in the operation of the Website resulting from technical, maintenance-related or independent reasons;
- damage resulting from malware, cyberattacks or other events beyond the reasonable control of the Service Provider;
- content, operation or privacy policies of external websites to which links placed on the Website lead;
- decisions made by the User based on general information available on the Website without prior individual agreement of the details of cooperation with the Service Provider.
- The Service Provider does not guarantee that the Website will be continuously available, free from errors, failures or security threats, but makes efforts to ensure its proper and safe operation.
12. Reporting irregularities
- The User may report comments regarding the operation of the Website, technical errors, outdated information, infringements of rights or violations of these Terms of Use by contacting the Service Provider at ato@ato.pl.
- The report should include:
- contact details of the reporting person;
- description of the matter;
- URL address of the subpage concerned by the report, if applicable;
- screenshots or other information helpful in clarifying the matter, if available.
- The Service Provider considers reports within a reasonable time, depending on the nature of the matter.
- A response may be provided to the e-mail address indicated by the User.
13. Changes to the Terms of Use
- The Service Provider reserves the right to amend the Terms of Use, in particular in the event of:
- changes in legal provisions;
- changes in Website functionality;
- changes in the Service Provider’s data;
- changes in the scope of services provided through the Website;
- changes in the manner of operation of the Website;
- the need to clarify the rules for using the Website.
- The current version of the Terms of Use is published on the Website.
- Changes to the Terms of Use apply from the moment they are published on the Website, unless another date is indicated in the Terms of Use.
14. Final provisions
- Matters not regulated by these Terms of Use shall be governed by Polish law.
- If any provision of these Terms of Use is found to be invalid or ineffective, this shall not affect the validity of the remaining provisions.
- These Terms of Use enter into force on the date of their publication on the Website.
- In the event of discrepancies between language versions of these Terms of Use, the Polish version shall prevail, unless mandatory provisions of law provide otherwise.
